General Terms and Conditions for use of the battlehighstreet.com website

By accessing the content of www.battlehighstreet.com (“the website”) you agree to be bound by the terms and conditions set out herein and you accept our privacy and accessibility policies.

Whilst Battle High Street endeavours to ensure that the information on this site is correct, no warranty, express or implied, is given as to its accuracy and Battle High Street Marketing does not accept any liability for error or omission.

Part of this site contains data submitted to Battle High Street by third parties. Third parties are responsible for ensuring that data submitted for inclusion on this site complies with national law.  Battle High Street Marketing cannot guarantee for accuracy of this data and hereby expressly disclaims any responsibility for error, omission or inaccuracy in the data, misinterpretation and any loss, disappointment, negligence or damage caused by reliance on the data contained on this site.  Confirmation of the accuracy and currency in the information should be sought from the establishments concerned.

Battle High Street Marketing shall not be liable for any damages (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from the use of or inability to use this site, or any data contained in it, or from any action or decision taken as a result of using this site or any such data.

Battle high Street Marketing accepts no responsibility for the content of any site to which a hypertext link from this site exists.  Such links are provided for your convenience on an “as is” basis with no warranty, express or implied, for the information provided within them.

By using the website you agree to respect the intellectual property right of Battle High Street Marketing and will refrain from copying, downloading, transmitting, reproducing, printing or exploiting for commercial purpose any data contained within the website.

Battle High Street Marketing does not guarantee uninterrupted availability of the website and cannot provide any representation of the website will be error free.

Battle High Street Marketing have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

Battle High Street Marketing reserves the right to change any part of this agreement without notice and your use of the website will be deemed as acceptance of this agreement.  We advise users to regularly check the Terms and Conditions of this agreement.

Online Offers

The offers are provided by the individual outlets on a discretionary basis.  We do occasionally check that they are being honoured, but the outlet has the right to withdraw the offer at any time and without notice.  The decision to supply the offer, or adjust the offer from time to time should be taken up with the outlet and Battle High Street has no jurisdiction and will not provide compensation howsoever sought for any withdrawal of offer.  If you feel an offer has not been provided as stated or has been withdrawn unfairly, you should first write to the business involved, if this redress has been sought and no response is forthcoming, you can write to us for further clarification and we may be able to assist as an intermediary only.  The outlets decision will be final.  Assuming all relevant laws have been followed.

On submission of payment/information you will have entered into a contract with Battle High Street.  The term is for one rolling year.  The agreed advertising will be displayed within 72 working hours of all relevant information being provided.  If you have selected a premium display you can ask for an explanation of how your advert will be prioritised, and dates agreed for when it will appear in each section.  Once the advert has been agreed and displayed, no refunds will be offered.  The contract will roll over to the next year automatically via the payment method originally used.  Should the payment be cancelled or fail, we will attempt contact to restablish the advert, if none is forthcoming, the advert will be removed and your companies details will be added to a basic standard free listing (Name, Telephone, Street Name).  If you are outside of the Battle High Street you advert will be removed entirely.  You can cancel the future payments at anytime by logging in and adjusting your payment method, or with 30 days notice in writing we can do it for you.

Payment details are stored securely and encrypted.

For the purposes of the free listings, Battle High Street is deemed to be from the Market Square roundabout, to the upper/lower lake/marley lane roundabout, and mount street shops up to the mount street car park turn off and the sprigs thereon.

Businesses beyond this will not be eligble for a free listing.  Sarah's Cellar will be used as the central location for the 3km radius measurements for any listing to be considered.

The decision of Battle High Street/Paul Truman will be final.
